Terms of Use

By downloading or using BabyGains Play, you agree to these Terms. If you do not agree, do not use the app.

BabyGains Play is operated by Baby Gains B.V., registered in the Netherlands. Contact: privacy@babygains.nl.

You must be 18 or older to create an account.

Children aged 0–8 may use the app under your direct supervision.

You are responsible for your child's use of the app.

BabyGains Play provides:

• Gamified daily-movement routines for children
• Progress tracking, streaks, badges, milestones
• An optional AI Coach (powered by Anthropic Claude)
• An optional Tribe social feed for parents
• Gear workouts referencing Baby Gains physical equipment

The app is an entertainment and habit-building tool. It is not medical advice, a substitute for professional health or fitness guidance, or a therapeutic intervention. Consult your paediatrician before starting any exercise programme with your child.

You are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• The accuracy of the child profiles you create

You may create one account per family unit. Sub-profiles (children) are managed within your account.

The "Founding 500" offer grants Premium access to BabyGains Play for a one-time payment of €49 (or local-currency equivalent).

• Payment is processed by Apple App Store or Google Play Store (in-app), or by Stripe (on the web)
• The price is fixed at the time of purchase; future changes do not affect your access
• "Premium Forever" means for as long as BabyGains Play exists as a service
• No refunds after content has been accessed, subject to applicable law
• If the service is discontinued, we provide at least 90 days' notice, and where reasonably possible we offer to export your data before shutdown

To restore a previous purchase: Profile → Settings → Restore Purchases.

The AI Coach feature sends your messages to Anthropic, Inc. to generate responses.

• You must explicitly consent before using this feature
• You're chatting with AI, not a human
• Do not share sensitive personal or medical information
• AI responses are generated by a machine-learning model and may be inaccurate
• We are not responsible for decisions made based on AI Coach responses
• You can disable the AI Coach at any time in Settings

By posting in the Tribe feed, you grant Baby Gains B.V. a non-exclusive, worldwide, royalty-free licence to display your content within the app.

You must not post:

• Content that is abusive, harassing, or threatening
• Personally identifying information about any child
• Photographs of other people's children without their consent
• Commercial solicitation or spam
• Content that violates any law

We may remove any content and suspend any account that violates these rules. To report a post: tap the ⋯ button on any post → Report. After three reports, a post is auto-hidden pending review.

BabyGains Play recommends movement activities for children. By using the app you confirm that:

• You have assessed that the activities are appropriate for your child
• You supervise your child during all movement activities
• You will consult a doctor if your child has any medical conditions

Adult supervision is required. Stop if your child shows pain or discomfort. Baby Gains B.V. is not liable for any injury that occurs during use of the app.

All content in BabyGains Play — including illustrations, exercise sequences, badge designs, sounds, and the Baby Gains brand — is the property of Baby Gains B.V. or its licensors. You may not copy, reproduce, or distribute this content without written permission.

Baby Gains physical gear (black metal dumbbells, kettlebells, resistance bands with yellow Baby Gains branding) are registered product designs of Baby Gains B.V.

We aim for 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance.

To the maximum extent permitted by Dutch and EU law, Baby Gains B.V.'s liability for any claim arising from use of the app is limited to the amount you paid for the service in the 12 months preceding the claim.

We are not liable for:

• Indirect or consequential damages
• Data loss (we back up your data via Supabase but cannot guarantee against all loss)
• Decisions made based on AI Coach responses

EU consumers retain any mandatory consumer-protection rights under their local law.

These Terms are governed by Dutch law. Disputes are subject to the exclusive jurisdiction of the courts of the Netherlands. EU consumers retain any mandatory consumer-protection rights under their local law.

We notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance.
